1. Acceptance of Terms

By downloading, installing, or using the ToxScan mobile application ("App"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, do not use the App. These Terms constitute a legally binding agreement between you and BetterPath Works LLC, the publisher of the ToxScan App ("Company," "we," "us," or "our").

2. Informational Use Only — Not Medical Advice

The App and all content provided through it, including ingredient analyses, risk scores, and health flags, are for informational and educational purposes only. Nothing in the App constitutes medical advice, diagnosis, treatment, or a substitute for professional medical judgment.

Always consult a qualified healthcare professional before making decisions about products you use, especially if you have existing health conditions, are pregnant, breastfeeding, or are purchasing products for children. Do not disregard professional medical advice or delay seeking it because of information obtained from the App.

3. AI-Generated Content Disclaimer

ToxScan uses artificial intelligence services, including Microsoft Azure OpenAI Service, to analyze ingredient lists. AI-generated analyses may contain inaccuracies, omissions, or errors. We do not warrant that any analysis is complete, accurate, up-to-date, or suitable for any particular purpose.

Ingredient databases and scientific consensus evolve. A substance classified as low-risk today may be reclassified in the future. ToxScan analyses reflect our best understanding at the time of generation and should not be treated as definitive safety determinations.

4. No Warranty on Ingredient Analysis Accuracy

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE." WE EXPRESSLY DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT.

We do not warrant that (i) ingredient identifications are complete or correct, (ii) risk scores reflect current scientific consensus, (iii) the App will be error-free or uninterrupted, or (iv) any particular ingredient or product is safe or unsafe for your specific circumstances.

5. Data Collection and Privacy

By using the App, you consent to our collection and use of data as described in our Privacy Policy. We collect:

  • Account information (email address via Firebase Authentication)
  • Scan history (product names, ingredient analyses, safety scores)
  • Health profile flags you voluntarily provide (e.g., pregnancy, thyroid conditions)
  • Usage analytics via Azure Application Insights (anonymized)

We store product images temporarily on Azure Blob Storage and delete them within 24 hours of upload. We do not sell your personal data.

6. User Responsibilities

You agree not to:

  • Use the App for any unlawful purpose or in violation of applicable law
  • Reverse-engineer, decompile, disassemble, or attempt to derive the source code of the App
  • Scrape, crawl, or systematically extract data from the App or our backend services
  • Use automated tools to submit scan requests at rates exceeding normal human usage
  • Attempt to bypass security measures or access systems not intended for you
  • Reproduce, distribute, or create derivative works based on ToxScan content without written permission
  • Impersonate any person or entity or misrepresent your affiliation with any person or entity

7. Intellectual Property

The App, including its design, code, AI models, brand assets, logo, trademarks, and all content, are owned by ToxScan and protected by United States and international intellectual property laws. Nothing in these Terms grants you any right, title, or interest in the App beyond the limited license to use it for personal, non-commercial purposes.

User-submitted scan data (photographs of ingredient labels) remains your property. By submitting scans, you grant ToxScan a limited, worldwide, royalty-free license to process and analyze that data to provide the App's services.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL TOXSCAN, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH:

  • Your use of or inability to use the App
  • Any reliance on App analyses, risk scores, or ingredient information
  • Any unauthorized access to or alteration of your data
  • Any health decisions made based on App content

In no event shall ToxScan's total aggregate liability to you exceed the greater of (i) $100 USD or (ii) the total amounts you paid to ToxScan in the twelve months preceding the claim.

9. Indemnification

You agree to indemnify, defend, and hold harmless ToxScan and its officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the App.

10. Third-Party Services

The App relies on third-party services including Google Firebase, Microsoft Azure, and Azure OpenAI Service. Your use of those services is governed by their respective terms of service and privacy policies, which we encourage you to review. We are not responsible for the practices of these third parties.

11. Changes to Terms

We may revise these Terms at any time. When we make material changes, we will update the "Last updated" date and, where reasonably practicable, notify you via the App or email. Your continued use of the App after changes become effective constitutes acceptance of the revised Terms.

12. Termination

We reserve the right to suspend or terminate your access to the App at any time, for any reason, including violation of these Terms, without notice and without liability. Upon termination, your right to use the App ceases immediately.

13. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to conflict of law principles. Any dispute arising under or relating to these Terms shall be resolved exclusively in the state or federal courts located in Delaware. You waive any objection to venue in such courts.
